⚠ No Work Injuries ⚠

Dr. Post and Zumbrota Chiropractic Clinic are unable to evaluate or treat worker’s compensation injuries, period. If you are hurt at work, you must obtain evaluation and treatment from a provider that meets all of the requirements to do so. While Dr. Post has extensive knowledge and treatment experience with treating common work injuries such as neck pain, thoracic pain, low back pain, etc. the State of Minnesota produces laws and website verbiage that make it hard to understand that work injuries cannot be treated by Dr. Post or Zumbrota Chiropractic clinic.

 

There are certain times where the State of Minnesota make it look like you can choose any provider that you want to treat injuries sustained at work, such as this line taken directly from their website: “Employees may choose their health care provider for treatment of a work-related injury.” In a recent case I learned that this is a blatantly FALSE statement from the State of Minnesota. I in turn was threatened by one of the departments of the State of Minnesota with professional and legal action if I did not follow through with their demands.

 

In a second example of this case, directly from their online documentation, reads:


Allowing Treatment with a Non-Participating Provider (Minnesota Rules Part 5221.0500, Subp.1)

There are several exceptions to the requirement that an employee treat with a participating provider.

The first exception allows an employee to see a health care provider outside the CMCO network if all of the following apply:
• the treatment is within the provider’s scope of practice
• the provider maintains the employee’s medical records
• the provider has a documented history of treatment with the employee before the date of injury

A documented treatment history is deemed established if the employee had at least two visits with the provider within the two years preceding the date of the injury.


CHECK, CHECK, and CHECK. So, even if you, as an injured worker who gets hurt at work you don’t seem to actually choose your own provider to treat you HOWEVER, if you fit the all of the points of the first exemption you might think that you should be able to come to Zumbrota Chiropractic clinic and chose Dr. Post to help you recover from these injuries, right? NOPE, that’s another blatantly FALSE statement as well. Two FALSE statements = ???

 

What it comes down to, I guess, is that if you have been hurt at work, the State of Minnesota will NOT let you come to be treated by Dr. Post at Zumbrota Chiropractic clinic. Looking at what they write on their website and within their documents available online, it looks like you should be able to, however, that is totally FALSE, as I have learned first-hand.

 

If you have been hurt at work, the best thing you can possibly do for yourself is report the injury as soon as you can and ask your employer where you are allowed to go for treatment. Unfortunately, I have a letter from the State of Minnesota which tells me that I am not allowed to treat you.

 

Another fine example of the current state of our disorganized government.
